Welcome to VibeyFest. These Terms of Service ("Terms") govern your access to and use of the VibeyFest website at vibeyfest.com and any related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About VibeyFest

VibeyFest is a festival trip planning platform that uses AI to generate personalized travel plans for music festival attendees, including recommendations for flights, accommodations, transportation, set schedules, and festival-specific tips. VibeyFest is operated as a sole proprietorship based in Washington State, United States.

2. Eligibility

You must be at least 18 years old to use the Service. By using VibeyFest you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Your Account

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for activity that occurs under your account.

4. The Service

What VibeyFest provides

VibeyFest generates AI-powered trip plans based on the information you provide. These plans include suggested flights, accommodations, transportation options, personalized set schedules, and festival tips. Plans may include affiliate links to third-party booking sites.

What VibeyFest does not provide

VibeyFest does not directly sell flights, hotel rooms, rental cars, festival tickets, or any other travel services. All bookings are made through third-party providers. VibeyFest is not responsible for the products or services offered by those third parties, including changes in price, availability, cancellation policies, or quality of service.

5. Pricing and Payments

VibeyFest offers a free tier and paid plans. Paid plan pricing is based on group size at the time of purchase:

• Solo or couple (1 to 2 people): $9 per plan
• Small group (3 to 6 people): $12 per plan
• Large group (7 or more people): $15 per plan

The first 500 founding members receive a 50% discount on all future plan purchases. Pricing is subject to change for new customers, but founding member discounts will continue to apply.

All payments are processed by Stripe. By making a purchase you also agree to Stripe's terms of service.

6. Refund Policy

Because VibeyFest generates a digital product immediately upon purchase, all sales are generally final. If you believe a plan was generated incorrectly or you experienced a technical problem, contact us at vibeyfest@gmail.com within 7 days of purchase and we will review your request in good faith. Refunds are issued at our discretion.

7. Affiliate Links and Third-Party Bookings

VibeyFest plans contain affiliate links to third-party services such as Booking.com, Skyscanner, Expedia, Airbnb, Rentalcars.com, Turo, Uber, Lyft, REI, and Amazon. When you click these links and make a qualifying purchase, VibeyFest may earn a commission at no additional cost to you. For more information, see our Affiliate Disclosure.

Any bookings you make through these third-party sites are subject to the terms, conditions, and policies of those providers. VibeyFest is not a party to those transactions and is not responsible for them.

8. AI-Generated Content

Trip plans are generated by AI based on information you provide and data available at the time of generation, including festival lineup data and real-time pricing where applicable. While we strive for accuracy, AI-generated recommendations may contain errors or outdated information. Always verify critical details such as flight times, dates, prices, and booking terms directly with the service provider before completing any booking.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Service, other user accounts, or any related systems.
• Use bots, scrapers, or automated tools to access the Service without our written permission.
• Resell, sublicense, or commercially exploit access to the Service.
• Upload or transmit malicious code, viruses, or harmful content.
• Harass, abuse, or harm other users.
• Misrepresent your identity or affiliation.

We may suspend or terminate accounts that violate these terms.

10. Intellectual Property

VibeyFest, its logo, branding, software, and all content on the site are the property of VibeyFest and protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal use only.

You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written permission.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by law, VibeyFest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including but not limited to lost profits, lost data, missed flights or bookings, or trip disruptions caused by third-party providers.

In no event shall our total liability to you for any claim related to the Service exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold VibeyFest harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Washington State.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated through the site or by email when appropriate.
